Terms of Use

These Terms of Use (“Terms”) constitute a legally binding agreement between you and Oskar Żółciński, operating under the brand name Neuro3DModels (“we,” “us,” or “our”) as an individual resident in Poland carrying out unregistered activity (działalność nierejestrowana) pursuant to Polish law. These Terms govern your access to and use of our website, 3D assets, open-source data, services, and related activities (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms personally and on behalf of any organization you represent, and you represent that you have the legal authority to do so. If you do not agree to these Terms, you may not access or use the Services.

1. The Services

Neuro3DModels provides professional 3D modeling, animation, and digital art services. Additionally, our Services include hosting a repository of free digital art and making use of open-source datasets.

2. Precedence of Service Agreements

If you have entered into a separate written Master Service Agreement (MSA) or Statement of Work (SOW) with us for custom 3D modeling or consulting services (a “Service Agreement”), the terms of that Service Agreement shall prevail in the event of any conflict with these general website Terms.

3. Intellectual Property and Licensing

Because our Services include a mix of proprietary commercial work, free community art, and third-party data, the following licensing rules apply to our Content:

  • Proprietary Content (All Rights Reserved): Unless explicitly marked otherwise, all website design, text, branding, portfolios, and custom commercial 3D assets (“Proprietary Content”) are created and owned personally by Oskar Żółciński (operating as Neuro3DModels) or licensed to us. You are granted a limited, non-exclusive, non-transferable, revocable license to access and view this Content for personal, non-commercial purposes only. You may not copy, sell, or create derivative works from Proprietary Content without our prior written consent.
  • Free Art (CC BY-NC-SA): Certain 3D models, textures, and artworks hosted on our Services are explicitly marked as available under the Creative Commons Attribution-NonCommercial-ShareAlike 4.0 International License (CC BY-NC-SA 4.0). For these specific assets, you are free to share and adapt the material, provided you give appropriate credit to Neuro3DModels, do not use the material for commercial purposes, and distribute your contributions under the exact same license.
  • Third-Party Data (CC BY): Our Services may utilize, display, or build upon third-party data and assets hosted under the Creative Commons Attribution License (CC BY) or similar. We provide appropriate attribution for this data as required by the licensors. If you extract or use this third-party data from our platform, you agree to maintain all attribution notices and comply with the original CC BY license terms.

4. Privacy and GDPR

Your use of the Services is subject to our Privacy Policy, which describes how we collect and process personal data in accordance with the EU General Data Protection Regulation (GDPR / RODO).

5. Your Materials and Acceptable Use

If you submit materials to us (e.g., reference images, project briefs, feedback), you represent that you have the right to do so and that your submission does not infringe on third-party rights.

  • Private Inquiries: Materials submitted privately for commercial project inquiries are treated as confidential and governed by our Privacy Policy and any applicable NDAs.
  • Acceptable Use: You agree not to use the Services to violate laws, infringe intellectual property, distribute malware, scrape data without permission, or disrupt the functionality of our platform.

6. Notice and Takedown (Copyright)

In accordance with the Polish Act on Providing Services by Electronic Means (Ustawa o świadczeniu usług drogą elektroniczną) and applicable EU laws, if you believe that any content hosted on our Services infringes your copyright, please contact us immediately at contact@neuro3dmodels.com. Upon receiving credible information regarding the illegal nature of your intellectual property, we will act promptly to remove or disable access to the infringing material.

7. Modifications to the Terms

We reserve the right to modify these Terms. If we make material changes, we will notify you by posting a prominent notice on our website at least 14 days before the changes take effect. Your continued use of the Services after the effective date constitutes your acceptance of the modified Terms.

8. Disclaimer of Warranties

The Services, including all CC-licensed art and open data, are provided “as is” and “as available,” without warranties of any kind. We disclaim all warranties, express or implied, including warranties of accuracy, reliability, and fitness for a particular purpose.

9. Limitation of Liability

To the maximum extent permitted by Polish law, Neuro3DModels shall not be liable for any indirect, incidental, consequential, or punitive damages.

For free users of the site and CC-licensed art, our total liability to you for any damages arising from your use of the Services shall not exceed €100 (or equivalent in PLN). For paying clients, liability shall be capped at the total amount paid to us in the 12 months preceding the claim.

Note: Under Polish civil law, this limitation does not apply to damages caused by intentional misconduct or gross negligence.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Poland, without regard to conflict-of-law principles.

  • General Jurisdiction: Any legal disputes arising from these Terms or the Services shall be submitted to the competent courts having jurisdiction over the operator’s place of residence in Warsaw, Poland.
  • Consumer Rights (EU/B2C): If you access the Services as a consumer residing in the EU, you retain all mandatory protection rights under the law of your country of residence, and you may bring legal proceedings in your local competent courts.

11. Electronic Communications

You consent to receive communications from us electronically. This satisfies any legal requirement under Polish and EU law that such communications be in writing.
